These Terms and Conditions (“Terms”) govern your access to and use of Democracy 2028 Inc. (“Democracy 2028,” “Company,” “we,” “our,” or “us”), including our website, mobile applications, candidate pages, verified politician profiles, livestreaming services, messaging tools, one-on-one audio calls, one-on-one video calls, video posts, image posts, text posts, virtual town halls, debates, notification systems, fact-checking services, payment services, subscriptions, and any other products or services offered by Democracy 2028.
By accessing, viewing, registering for, subscribing to, posting on, communicating through, purchasing services from, attending events on, or otherwise using Democracy 2028, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use Democracy 2028.
These Terms are intended to serve as a detailed draft for website use. Democracy 2028 Inc. should have this document reviewed by a qualified attorney before publishing it, especially because the platform involves political communication, candidate verification, election-related information, payments, public candidate profiles, communications with constituents, fact-checking, and legal limitations of liability.
1. About Democracy 2028
Democracy 2028 is a political social media and civic communication platform designed to allow verified politicians, candidates, campaigns, elected officials, political committees, and authorized political representatives to communicate directly with constituents and the American public.
Democracy 2028 allows approved and verified politicians to post profiles, news, events, livestreams, video posts, image posts, text posts, policy statements, announcements, campaign updates, public statements, and other political or civic communications.
Constituents may subscribe to candidate pages, receive notifications, comment on posts, like posts, attend virtual town halls, watch debates, participate in livestreams, and view candidate information.
Constituents do not create full public social media profiles for themselves in the same manner as candidates. Democracy 2028 is designed to be a candidate-centered civic platform where verified political figures can communicate directly with the public.
Democracy 2028 may automatically create public candidate profiles for individuals running for President of the United States, United States Senate, United States House of Representatives, and other public offices selected by Democracy 2028. These profiles may be created using publicly available information and may be maintained by Democracy 2028 until the candidate, campaign, or authorized representative claims and subscribes to the page.
2. Acceptance of Terms
By using Democracy 2028, you confirm that you have read, understood, and agree to these Terms.
If you are using Democracy 2028 on behalf of a candidate, campaign, political committee, public official, elected official, political organization, government office, corporation, nonprofit, partnership, or other legal entity, you represent and warrant that you are authorized to accept these Terms on behalf of that person or entity.
If you do not have such authority, you may not use Democracy 2028 on behalf of that person or entity.
Democracy 2028 reserves the right to deny, restrict, suspend, or terminate access to the platform if we believe a user has violated these Terms, violated applicable law, submitted false information, engaged in misconduct, misused platform tools, failed verification, failed to pay required fees, or created risk for Democracy 2028, candidates, constituents, elections, or the public.
3. Definitions
For purposes of these Terms, “User” means any person or entity that accesses, views, registers for, subscribes to, posts on, communicates through, attends events on, purchases services from, or otherwise uses Democracy 2028.
“Candidate” means an individual running for public office, including but not limited to President of the United States, United States Senate, United States House of Representatives, state office, local office, or any other public office selected by Democracy 2028.
“Politician” means a candidate, elected official, public official, officeholder, campaign representative, political committee, or verified political figure approved by Democracy 2028.
“Verified Politician” means a candidate, campaign, elected official, public official, political committee, or authorized representative whose identity, authority, or campaign affiliation has been reviewed and approved by Democracy 2028.
“Constituent” means a member of the public who subscribes to, follows, comments on, likes, receives notifications from, attends events for, communicates with, or otherwise interacts with a candidate page.
“Candidate Page” means a public profile page created, maintained, claimed, or operated on Democracy 2028 for a candidate, politician, campaign, elected official, or public officeholder.
“Claimed Candidate Page” means a candidate page that has been verified and officially claimed by a candidate, campaign, political committee, elected official, or authorized representative.
“Unclaimed Candidate Page” means a candidate page created or maintained by Democracy 2028 that has not yet been officially claimed by the candidate, campaign, political committee, elected official, or authorized representative.
“Content” means all text, images, video, audio, livestreams, comments, posts, messages, documents, links, graphics, campaign materials, public statements, candidate profile information, fact-checking submissions, event materials, debate materials, and other materials uploaded, submitted, posted, transmitted, displayed, streamed, or made available through Democracy 2028.
“Services” means all features, products, tools, websites, applications, systems, communications, payment tools, candidate pages, livestreams, debates, town halls, fact-checking services, subscriptions, and other services offered by Democracy 2028.
4. Eligibility
To use Democracy 2028, you must be at least 13 years old, unless a higher age is required by applicable law.
If you are under 18, you may use Democracy 2028 only with the consent and supervision of a parent or legal guardian.
Candidates, campaigns, political committees, elected officials, and authorized representatives must provide accurate information and may be required to complete verification before accessing candidate tools, claiming candidate pages, posting content, communicating with constituents, hosting events, or using paid services.
Democracy 2028 may refuse service to any person or entity where permitted by law.
5. Candidate Page Creation
Democracy 2028 may automatically create public candidate pages for individuals running for public office, including candidates for President of the United States, United States Senate, United States House of Representatives, state office, local office, and other public offices selected by Democracy 2028.
These candidate pages may include publicly available information such as candidate name, office sought, district or jurisdiction, political party affiliation, campaign website, public biography, official statements, public news, campaign information, public event information, publicly available images, and other lawful public information.
Democracy 2028 may maintain unclaimed candidate pages for informational, civic, public-interest, voter education, election-related, and platform organization purposes.
A candidate, campaign, political committee, elected official, or authorized representative will have no control over an unclaimed candidate page unless and until the page is claimed, verified, approved, and activated through Democracy 2028’s process.
6. Claiming a Candidate Page
Candidates, campaigns, political committees, elected officials, or authorized representatives may request to claim a candidate page.
To claim a candidate page, Democracy 2028 may require proof of identity, proof of candidacy, campaign authorization, government-issued identification, campaign committee documentation, official campaign email verification, website domain verification, public office verification, payment of applicable subscription or platform fees, and any additional documentation reasonably requested by Democracy 2028.
Democracy 2028 has the right to approve, deny, delay, suspend, restrict, or revoke candidate page claims if we believe the request is fraudulent, inaccurate, incomplete, misleading, unauthorized, unlawful, harmful, politically deceptive, or otherwise inconsistent with platform integrity.
Claiming a page does not mean Democracy 2028 endorses, supports, opposes, approves, certifies, or validates the candidate’s policy positions, campaign promises, public statements, qualifications, or political views.
7. Verified Politician Accounts
Only approved verified politicians, candidates, campaigns, political committees, elected officials, or authorized representatives may control official candidate pages and post official candidate content.
Verified politicians may be permitted to update official profiles, post campaign news, post policy statements, post announcements, publish videos, publish images, publish text posts, host livestreams, participate in debates, host virtual town halls, send notifications to subscribers, communicate with constituents through platform tools, offer one-on-one audio calls, offer one-on-one video calls, access analytics, request fact-checking services, purchase paid services, and use other tools made available by Democracy 2028.
Verification may be denied, suspended, or revoked if Democracy 2028 determines that a verified politician, campaign, or representative violated these Terms, submitted false information, impersonated another person, misused constituent information, violated applicable law, failed to pay required fees, created platform risk, or engaged in conduct harmful to Democracy 2028, voters, candidates, elections, or the public.
8. Constituents and Public Users
Constituents may use Democracy 2028 to view candidate pages, subscribe to candidate pages, receive notifications, comment on posts, like posts, attend virtual events, view debates, watch livestreams, and interact with candidate content where permitted.
Constituents may not create candidate-style public profiles unless separately approved by Democracy 2028.
Constituents may not impersonate candidates, campaigns, elected officials, public agencies, journalists, political organizations, government offices, or other individuals.
Constituents agree not to use Democracy 2028 to harass, threaten, defame, intimidate, impersonate, spam, mislead, abuse, stalk, exploit, defraud, or interfere with any candidate, campaign, user, event, debate, town hall, livestream, fact-checking service, or platform feature.
9. Subscriptions to Candidate Pages
Constituents may subscribe to candidate pages to receive posts, messages, updates, event notices, livestream alerts, debate notices, town hall notices, campaign communications, and other notifications from candidates or campaigns.
By subscribing to a candidate page, constituents acknowledge and agree that the candidate or campaign may communicate with them through Democracy 2028, they may receive platform notifications and candidate communications, their interaction with a candidate page may be used to provide platform functionality, their activity may be used to deliver communications and analytics, they may unsubscribe or adjust communication preferences where available, and Democracy 2028 may retain certain subscription and interaction records as permitted by law and the Privacy Policy.
Democracy 2028 may limit, suspend, or remove subscriptions if we believe they are fraudulent, automated, spam-related, abusive, unlawful, misleading, manipulated, or harmful.
10. Candidate Communications and Notifications
Democracy 2028 is designed to allow candidates and politicians to notify subscribed constituents when they post or communicate through the platform.
Democracy 2028’s goal is to provide broad and reliable notification delivery to subscribed constituents. However, users acknowledge that notifications may be affected by device settings, email filters, SMS carrier limitations, internet service issues, app permissions, spam filters, browser settings, platform maintenance, technical failures, third-party service providers, or other factors outside Democracy 2028’s control.
Democracy 2028 does not guarantee that every notification will be received, opened, read, viewed, delivered, or acted upon by every constituent.
Candidates are responsible for the content, timing, accuracy, legality, and compliance of their communications.
Candidates may not use platform communications to send unlawful messages, spam, harassment, threats, fraudulent solicitations, deceptive fundraising messages, voter suppression content, voter intimidation, unlawful campaign communications, or communications that violate these Terms.
11. Messaging, Audio Calls, and Video Calls
Democracy 2028 may offer messaging, one-on-one audio calls, one-on-one video calls, group communications, livestreams, or other communication tools between candidates and constituents.
Users agree to use communication tools lawfully, respectfully, and in accordance with these Terms.
Users may not use calls, messages, or communications to harass, threaten, intimidate, defraud, exploit, mislead, abuse, impersonate, or manipulate others.
Users may not share illegal, obscene, violent, hateful, threatening, defamatory, fraudulent, harmful, or unlawful content through communication tools.
Users may not record calls or conversations unless legally permitted and properly disclosed.
Democracy 2028 may monitor, moderate, record, review, store, restrict, preserve, or remove communications where permitted by law and where necessary for safety, compliance, dispute resolution, fraud prevention, user protection, platform integrity, election integrity, or enforcement of these Terms.
Candidates are solely responsible for any promises, representations, offers, campaign statements, fundraising statements, policy positions, commitments, or claims made during communications.
12. Virtual Town Halls and Debates
Democracy 2028 may host, promote, organize, livestream, record, distribute, moderate, archive, or sponsor virtual town halls, candidate debates, public forums, interviews, campaign events, and civic discussions.
Participation in Democracy 2028 events may be subject to additional rules, eligibility requirements, fees, technical requirements, moderation policies, scheduling requirements, participation standards, event formats, and conduct standards.
Democracy 2028 reserves the right to approve or deny participation in events, set event formats and rules, moderate discussions, remove disruptive participants, record and archive events, edit event clips for promotional or informational purposes, cancel or reschedule events, establish participation procedures, refuse to host unlawful or unsafe events, and enforce platform standards.
Participation in a Democracy 2028 event does not constitute endorsement by Democracy 2028.
13. Fact-Checking Services
Democracy 2028 may offer paid fact-checking services to candidates, campaigns, political organizations, elected officials, public officials, political committees, or other approved users.
A candidate or campaign may submit a public statement, claim, post, advertisement, article, video, image, debate statement, social media post, public accusation, or other content for review.
By submitting a fact-check request, the requesting party agrees that Democracy 2028 may charge a fee for the service, payment does not guarantee a favorable result, Democracy 2028 will determine the scope and format of the review, Democracy 2028 may determine the timing and publication of the fact-check, results may be publicly posted, and results may include findings, explanations, sources, context, and conclusions.
Democracy 2028 may decline fact-check requests that are incomplete, abusive, frivolous, defamatory, unsafe, unlawful, outside the scope of service, politically manipulative, unsupported, or otherwise inappropriate.
Democracy 2028 may use internal reviewers, external experts, contractors, researchers, automated tools, third-party sources, public records, official documents, media sources, government records, campaign materials, or other methods in conducting reviews.
Democracy 2028 will strive to provide fair, accurate, unbiased, and good-faith fact-checking. However, users acknowledge that fact-checking may involve judgment, interpretation, evolving facts, incomplete information, disputed sources, conflicting records, and changing public information.
Democracy 2028 does not guarantee that any fact-check will be error-free, complete, final, universally accepted, legally determinative, politically neutral in perception, or immune from dispute.
14. Public Posting of Fact-Check Results
Fact-check results may be publicly posted on Democracy 2028.
By requesting fact-checking services, the requesting party authorizes Democracy 2028 to publish the result, whether favorable, unfavorable, mixed, inconclusive, corrective, disputed, or otherwise.
Democracy 2028 may refuse to remove fact-check results unless required by law or unless Democracy 2028 determines that removal, correction, clarification, or revision is appropriate.
Democracy 2028 may issue updates, corrections, clarifications, revisions, or supplemental notes if new information becomes available or if we determine that a prior result requires modification.
15. Candidate Content Responsibility
Candidates, campaigns, verified politicians, political committees, and authorized representatives are solely responsible for all content they post, publish, stream, transmit, upload, or distribute through Democracy 2028.
Candidate content must not violate federal, state, or local law; defame, harass, threaten, or intimidate others; impersonate another person or entity; contain knowingly false statements of material fact; violate election laws, campaign finance laws, advertising laws, disclosure rules, or communications regulations; encourage voter intimidation, voter suppression, violence, fraud, or unlawful activity; infringe copyrights, trademarks, publicity rights, privacy rights, or other rights; contain malware, spyware, harmful code, or deceptive links; misuse personal data; promote scams, fraud, illegal fundraising, or deceptive solicitations; contain unlawful hate speech or targeted harassment; or interfere with platform operations or public safety.
Democracy 2028 may remove, restrict, label, fact-check, demonetize, suspend, preserve, or report content if we believe it violates these Terms, our policies, applicable law, user safety, election integrity, or platform integrity.
16. Constituent Comments and Likes
Constituents may comment on and like candidate posts where such features are available.
Constituent comments must be lawful, respectful, and relevant.
Democracy 2028 may remove, hide, restrict, preserve, or moderate comments that contain threats, violence, harassment, abuse, hate speech, spam, scams, defamation, impersonation, personal information posted without permission, malware, harmful links, obscene content, illegal content, voter intimidation, voter suppression, repeated disruption, or content that violates platform rules.
Candidates may be given moderation tools subject to Democracy 2028 policies. However, Democracy 2028 reserves the final right to moderate, restrict, preserve, remove, review, or report comments.
17. No Endorsement
Democracy 2028 does not endorse any candidate, campaign, political party, ideology, public official, elected official, policy position, political advertisement, political statement, event, debate participant, livestream, fact-check request, or user content unless expressly stated in writing by Democracy 2028.
The presence of a candidate profile on Democracy 2028 does not mean Democracy 2028 supports, opposes, verifies, approves, validates, or endorses the candidate’s positions, statements, campaign materials, qualifications, promises, or political views.
Democracy 2028 is designed to provide a platform for verified political communication, candidate information, and public civic access.
18. Equal Treatment and Platform Access
Democracy 2028’s goal is to provide a platform where candidates running for public office can be presented to the public in a consistent, accessible, organized, and civic-focused manner.
Democracy 2028 may establish different subscription plans, verification requirements, event participation rules, promotional opportunities, service tiers, pricing, candidate tools, platform features, and support levels based on business, technical, compliance, legal, operational, or platform integrity considerations.
Democracy 2028 may offer paid services, premium features, promotional placements, event access, enhanced candidate tools, analytics, livestreaming capabilities, or additional services.
Nothing in these Terms requires Democracy 2028 to provide identical features, pricing, placement, event participation, visibility, analytics, support, or services to every candidate in every circumstance, unless required by applicable law.
19. Fees, Payments, and Subscriptions
Candidates, campaigns, political committees, organizations, elected officials, public officials, or users may be required to pay fees for certain Democracy 2028 services.
Paid services may include claiming and managing candidate pages, candidate subscription plans, premium communication tools, livestreaming features, virtual town halls, debates, advertising or promotional services, fact-checking services, audio or video call features, analytics tools, enhanced profile placement, platform support, and other paid services.
All fees are subject to change.
By purchasing any paid service, you agree to provide accurate billing information and authorize Democracy 2028 or its payment processors to charge all applicable fees, taxes, and charges.
Failure to pay fees may result in suspension, restriction, downgrade, cancellation, or termination of services.
Unless otherwise stated in writing, fees are non-refundable.
20. Refund Policy
Democracy 2028 may establish separate refund policies for subscription plans, fact-checking services, town halls, debates, livestreams, promotional services, or other paid offerings.
Unless a separate written refund policy applies, all payments are final and non-refundable.
Democracy 2028 may, at its sole discretion, issue refunds, credits, or service adjustments on a case-by-case basis.
No refund will be provided for candidate disqualification, campaign suspension, loss of election, failure to use purchased services, removal of content for violation of these Terms, user dissatisfaction with fact-check results, candidate withdrawal from a race, technical issues outside Democracy 2028’s reasonable control, violation of platform policies, failure to provide required verification documents, or failure to achieve political, fundraising, visibility, or campaign results.
21. Taxes and Campaign Finance Compliance
Candidates, campaigns, political committees, political organizations, public officials, and users are solely responsible for determining and complying with any tax, campaign finance, election law, reporting, disclosure, contribution, expenditure, advertising, recordkeeping, payment, communications, or compliance obligations related to their use of Democracy 2028.
Democracy 2028 does not provide legal, tax, campaign finance, election law, accounting, or political compliance advice.
Candidates and campaigns should consult their own legal counsel, compliance professionals, treasurers, campaign finance advisors, and tax professionals before using paid services, accepting payments, linking to fundraising platforms, or conducting campaign communications through Democracy 2028.
22. Political Advertising and Campaign Communications
Democracy 2028 may offer political advertising, sponsored content, promoted posts, featured candidate tools, or other campaign communication services.
All political advertisements and paid campaign communications must comply with applicable laws, including federal, state, and local election laws, advertising laws, disclosure rules, campaign finance regulations, and Democracy 2028 policies.
Democracy 2028 may require disclaimers, sponsor information, identity verification, payment verification, recordkeeping, additional review, or legal compliance documentation before approving political advertisements or paid communications.
Democracy 2028 may reject, remove, label, limit, suspend, or refuse any advertisement or communication at its discretion.
23. Donations, Fundraising, and Campaign Contributions
Democracy 2028 may allow candidates to link to fundraising pages, donation portals, campaign websites, payment processors, or third-party contribution platforms.
Unless expressly stated in writing, Democracy 2028 does not process campaign contributions directly and is not responsible for candidate fundraising compliance.
Candidates and campaigns are solely responsible for ensuring that all fundraising activity complies with applicable campaign finance laws, contribution limits, donor eligibility rules, disclosure requirements, reporting obligations, disclaimers, and payment processing requirements.
Democracy 2028 may restrict or remove fundraising links that appear unlawful, deceptive, fraudulent, misleading, noncompliant, or harmful.
24. User Data and Privacy
Your use of Democracy 2028 is also governed by the Democracy 2028 Privacy Policy, which explains how we collect, use, store, disclose, and protect personal information.
By using Democracy 2028, you agree to the Privacy Policy.
Candidates and campaigns may receive access to certain constituent engagement tools or communication features. Candidates and campaigns agree that they will use constituent information only as permitted by Democracy 2028, the Privacy Policy, applicable law, and any additional data-use agreements.
Candidates and campaigns may not sell, misuse, scrape, export, share, rent, transfer, abuse, or unlawfully process constituent information obtained through Democracy 2028.
25. Constituent Data and Candidate Access
When a constituent subscribes to a candidate page, Democracy 2028 may allow the candidate or campaign to communicate with that constituent through approved platform tools.
Democracy 2028 may restrict what information is shared with candidates or campaigns.
Candidates and campaigns agree that constituent information accessed through Democracy 2028 may only be used for lawful campaign, civic, public-service, or political communication purposes consistent with these Terms, the Privacy Policy, and applicable law.
Candidates and campaigns may not use constituent data to harass or intimidate voters, suppress voting, discriminate unlawfully, sell or transfer data to unauthorized third parties, send unlawful spam, engage in fraud, violate privacy laws, create unauthorized external databases, target individuals unlawfully, misrepresent the source or purpose of communications, or engage in any conduct that Democracy 2028 determines is harmful or unlawful.
26. Consent to Communications
By using Democracy 2028, subscribing to candidate pages, creating an account, claiming a candidate page, submitting a form, attending an event, requesting fact-checking, purchasing services, or using platform features, you consent to receive communications from Democracy 2028.
These communications may include account notices, candidate page updates, platform notifications, email messages, SMS messages where permitted and consented to, push notifications, event reminders, security alerts, billing notices, policy updates, service announcements, fact-checking updates, customer support messages, and candidate-related communications for pages you subscribe to.
You may opt out of certain communications where available. However, some service, security, legal, transactional, payment, and account-related communications may be required.
Message and data rates may apply.
27. Platform Moderation
Democracy 2028 may moderate content, accounts, comments, livestreams, events, debates, messages, candidate pages, fact-checking submissions, and user activity to protect the platform, users, candidates, voters, elections, and the public.
Moderation actions may include removing content, restricting content, labeling content, fact-checking content, suspending accounts, terminating accounts, limiting posting privileges, restricting comments, disabling livestreams, canceling events, removing verification, preserving records, reporting unlawful activity to authorities where appropriate, refusing paid services, requiring corrective action, issuing warnings, or taking other actions Democracy 2028 considers appropriate.
Democracy 2028 is not obligated to monitor all content and does not guarantee that harmful, inaccurate, offensive, misleading, or unlawful content will never appear.
28. Prohibited Conduct
You agree not to violate any law or regulation; impersonate any person, candidate, campaign, office, agency, party, or organization; create fake accounts; misrepresent your identity or authority; harass, threaten, or intimidate others; post defamatory content; upload malware or harmful code; interfere with platform systems; attempt unauthorized access; scrape, crawl, or harvest data without permission; send spam or unsolicited bulk messages; manipulate likes, comments, views, subscriptions, or engagement metrics; use bots or automated systems without authorization; engage in voter intimidation or suppression; post unlawful campaign communications; promote violence or illegal activity; violate intellectual property rights; misuse personal information; circumvent payment systems; submit fraudulent fact-check requests; disrupt town halls, debates, livestreams, or events; deceive voters; or use Democracy 2028 in a way that damages public trust, platform integrity, candidate safety, user safety, or election safety.
29. Election Integrity
Democracy 2028 is committed to supporting lawful civic engagement and election-related communication.
Users may not use Democracy 2028 to provide false information about voting dates, times, locations, methods, eligibility, or procedures; intimidate or threaten voters; suppress voter participation; misrepresent election results; impersonate election officials; interfere with election administration; promote unlawful voting schemes; encourage violence related to elections; publish manipulated election materials in a deceptive manner; engage in coordinated inauthentic behavior; or deceive voters about candidates, campaigns, voting, election processes, or public offices.
Democracy 2028 may remove, label, restrict, fact-check, preserve, or report content that threatens election integrity.
30. Artificial Intelligence and Synthetic Media
Candidates, campaigns, and users must clearly disclose when content includes materially deceptive artificial intelligence, deepfakes, synthetic media, voice cloning, image manipulation, or generated media that could mislead voters about a candidate, public official, event, statement, endorsement, policy position, or election-related matter.
Democracy 2028 may require labels such as “AI Generated Content,” “Synthetic Media,” “Edited Media,” or similar disclosures.
Democracy 2028 may remove, restrict, label, preserve, or report AI-generated or manipulated content that is deceptive, harmful, unlawful, or likely to mislead the public.
31. Intellectual Property Rights
Democracy 2028 owns or licenses all rights, title, and interest in the platform, including its software, design, layout, trademarks, logos, branding, trade names, technology, databases, algorithms, systems, features, content organization, user interface, and proprietary materials.
You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, scrape, decompile, exploit, or create derivative works from Democracy 2028 without written permission.
All trademarks, logos, and service marks displayed on Democracy 2028 are the property of Democracy 2028 or their respective owners.
32. User Content License
By posting, uploading, submitting, streaming, transmitting, or otherwise providing content to Democracy 2028, you grant Democracy 2028 a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, copy, reproduce, display, publish, distribute, transmit, stream, perform, modify for formatting, promote, archive, translate, summarize, clip, and otherwise use the content in connection with operating, improving, promoting, protecting, and providing Democracy 2028.
This license includes the right to use candidate posts, livestreams, town halls, debates, clips, images, public statements, public comments, profile content, and event content for platform promotion, civic education, archival purposes, public access, platform operations, and service improvement.
You represent and warrant that you own or have the necessary rights to all content you submit.
You retain ownership of your content, subject to the license granted to Democracy 2028.
33. Use of Candidate Name, Image, and Likeness
Candidates, campaigns, political committees, elected officials, and verified politicians grant Democracy 2028 permission to use their name, image, likeness, campaign logo, office sought, biography, public statements, public campaign information, event information, and related materials for purposes of operating, displaying, promoting, organizing, and maintaining candidate pages, town halls, debates, fact-checks, and platform services.
Democracy 2028 may use publicly available candidate information for unclaimed candidate pages, civic education, voter information, public-interest reporting, and platform organization.
Use of candidate information does not constitute endorsement.
34. Copyright Complaints
If you believe content on Democracy 2028 infringes your copyright, you may submit a copyright complaint to Democracy 2028 with sufficient information to identify the copyrighted work, the allegedly infringing material, your contact information, and a statement that you have a good-faith belief that the use is not authorized.
Democracy 2028 may remove or disable access to allegedly infringing content and may terminate repeat infringers where appropriate.
A full copyright policy may be provided separately.
35. Third-Party Content and Links
Democracy 2028 may contain links to third-party websites, videos, articles, campaign websites, donation platforms, payment processors, livestream tools, social media pages, news sources, public records, government websites, or other external materials.
Democracy 2028 is not responsible for third-party content, websites, services, privacy practices, security practices, accuracy, availability, payment systems, or policies.
Accessing third-party links is at your own risk.
36. No Professional Advice
Democracy 2028 does not provide legal, tax, financial, accounting, campaign finance, political consulting, election law, compliance, voting, or professional advice.
Information on the platform is provided for general civic, communication, informational, platform-related, or public-interest purposes only.
Candidates, campaigns, and users should consult qualified professionals before relying on any information for legal, campaign, compliance, tax, financial, election-related, or political decisions.
37. Accuracy of Information
Democracy 2028 may display candidate information, public records, campaign information, election information, office information, news, public statements, fact-checking results, and user-submitted content.
While Democracy 2028 may attempt to provide accurate and useful information, we do not guarantee that all information on the platform is complete, current, accurate, error-free, or suitable for any specific purpose.
Candidates are encouraged to claim and update their pages to ensure voters receive current information.
Users should independently verify important information, especially information related to voting, elections, campaign finance, official government procedures, candidate qualifications, public policy, and legal obligations.
38. Platform Availability
Democracy 2028 may be unavailable from time to time due to maintenance, updates, outages, cyberattacks, technical failures, third-party service disruptions, internet failures, power failures, force majeure events, or other causes.
Democracy 2028 does not guarantee uninterrupted, secure, error-free, or continuous operation.
We may modify, suspend, discontinue, remove, replace, or restrict any part of the platform at any time.
39. Security
Users are responsible for maintaining the confidentiality of their account credentials.
Candidates, campaigns, political committees, and verified users must promptly notify Democracy 2028 of any unauthorized access, suspected account compromise, security breach, impersonation, or misuse.
Democracy 2028 may require additional security measures for candidate accounts, including multi-factor authentication, identity verification, access controls, administrator restrictions, or campaign authorization procedures.
Users are responsible for all activity occurring through their accounts unless caused solely by Democracy 2028’s gross negligence or willful misconduct.
40. Account Suspension and Termination
Democracy 2028 may suspend, restrict, or terminate accounts, candidate pages, subscriptions, services, event access, livestreaming privileges, posting privileges, verification, or platform access if we believe a user has violated these Terms, violated applicable law, failed verification, failed to pay fees, misused platform tools, posted harmful or unlawful content, engaged in fraud or impersonation, threatened platform security, misused constituent data, interfered with election integrity, created legal risk, created reputational risk, created safety risk, created technical risk, or created operational risk for Democracy 2028.
Termination may occur with or without notice, subject to applicable law.
41. Preservation of Records
Democracy 2028 may preserve records, content, messages, event recordings, candidate posts, comments, fact-checking submissions, payment records, verification documents, IP logs, device information, account activity, and communications where permitted or required by law.
Records may be preserved for compliance, security, fraud prevention, dispute resolution, law enforcement requests, legal process, public-interest archiving, election integrity, payment disputes, user safety, or platform operations.
42. Law Enforcement and Legal Requests
Democracy 2028 may disclose information if required by subpoena, court order, search warrant, warrant, legal process, lawful government request, or applicable law.
We may also disclose information if we believe in good faith that disclosure is necessary to protect users, candidates, Democracy 2028, elections, public safety, legal rights, platform security, or election integrity.
43. Disclaimers
Democracy 2028 is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Democracy 2028 disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, reliability, uninterrupted service, and error-free operation.
Democracy 2028 does not guarantee election outcomes, candidate success, voter support, fundraising results, debate participation, media coverage, subscriber growth, notification receipt, increased visibility, favorable fact-checking outcomes, error-free platform performance, absence of harmful content, absence of inaccurate content, absence of misleading content, or uninterrupted access to the platform.
44. Waiver of Claims and Right to Sue
By accessing, viewing, registering for, subscribing to, posting on, communicating through, attending events on, purchasing services from, submitting information to, or otherwise using Democracy 2028, each user agrees, to the fullest extent permitted by applicable law, that the user waives, releases, and gives up any and all rights to bring, file, initiate, participate in, maintain, or pursue any lawsuit, litigation, claim, demand, action, arbitration, proceeding, complaint, cause of action, or legal challenge against Democracy 2028 Inc., its officers, directors, employees, contractors, consultants, advisors, board members, vendors, volunteers, affiliates, service providers, business partners, technology partners, content partners, event partners, payment processors, representatives, agents, successors, and assigns, for any reason arising out of or related to the user’s access to, use of, inability to use, reliance on, interaction with, or participation in Democracy 2028.
Users of Democracy 2028 waive their rights to bring suit or litigation against Democracy 2028 Inc., its officers, employees, contractors, consultants, advisors, board members, vendors, volunteers, partners, and partners for any reason.
This waiver is intended to apply broadly to all claims, including but not limited to claims related to privacy, data collection, data use, data sharing, data disclosure, candidate profiles, unclaimed candidate pages, claimed candidate pages, candidate communications, constituent subscriptions, comments, likes, livestreams, debates, town halls, fact-checking services, payment services, subscription services, notifications, account suspension, content moderation, content removal, platform errors, platform outages, candidate statements, constituent comments, public information, third-party links, third-party services, unauthorized access, security incidents, election-related communications, political content, loss of data, loss of opportunity, reputational harm, financial harm, campaign harm, political harm, emotional distress, or any other alleged injury or damage.
Nothing in this section is intended to waive rights that cannot legally be waived under applicable law. If any portion of this waiver is found invalid, unlawful, or unenforceable, the remaining portions shall remain in effect to the maximum extent permitted by law.
45. Limitation of Liability
To the fullest extent permitted by law, Democracy 2028 Inc. and its officers, directors, employees, contractors, consultants, advisors, board members, vendors, volunteers, affiliates, service providers, business partners, technology partners, content partners, event partners, payment processors, representatives, agents, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, reputational, political, electoral, financial, emotional, or lost-profit damages arising out of or related to Democracy 2028.
This includes damages related to lost campaign opportunities, lost votes, lost donations, lost revenue, lost data, reputational harm, political harm, campaign harm, platform outages, removed content, failed notifications, fact-checking results, event cancellations, account suspensions, third-party conduct, candidate statements, constituent comments, election outcomes, payment disputes, security incidents, or inability to access the platform.
To the fullest extent permitted by law, Democracy 2028’s total liability for any claim shall not exceed the amount paid by you to Democracy 2028 in the six months preceding the event giving rise to the claim, or $100 if no amount was paid.
46. Indemnification
You agree to defend, indemnify, and hold harmless Democracy 2028 Inc. and its officers, directors, employees, contractors, consultants, advisors, board members, vendors, volunteers, affiliates, service providers, business partners, technology partners, content partners, event partners, payment processors, representatives, agents, successors, and assigns from and against any claims, damages, liabilities, losses, costs, expenses, demands, investigations, penalties, fines, and attorney’s fees arising out of or related to your use of Democracy 2028, your content, your violation of these Terms, your violation of law, your violation of election laws or campaign finance rules, your misuse of constituent data, your communications with users, your fundraising activities, your candidate statements, your fact-checking submissions, your event participation, your infringement of intellectual property rights, your fraud, your impersonation, your negligence, or your misconduct.
This obligation survives termination of your account or use of Democracy 2028.
47. Dispute Resolution
Before filing any claim, you agree to first contact Democracy 2028 and attempt to resolve the dispute informally.
If a dispute cannot be resolved informally, the parties may proceed according to the governing law and venue provisions below, unless another dispute resolution process is required by applicable law or a separate written agreement.
Democracy 2028 may seek immediate injunctive or equitable relief in court for unauthorized access, intellectual property misuse, data misuse, platform interference, security threats, impersonation, fraud, or other urgent matters.
48. Governing Law
These Terms shall be governed by the laws of the State of [Insert State], without regard to conflict of law principles.
You agree that any legal action related to these Terms or Democracy 2028 shall be brought in the state or federal courts located in [Insert County and State], unless otherwise required by applicable law.
49. Class Action Waiver
To the fullest extent permitted by law, you agree that disputes with Democracy 2028 must be brought on an individual basis and not as a class action, collective action, consolidated action, mass action, private attorney general action, or representative proceeding.
50. Changes to These Terms
Democracy 2028 may update these Terms from time to time.
When changes are made, we may update the “Last Updated” date and may provide notice through the platform, email, website notice, in-app message, or other reasonable methods.
Your continued use of Democracy 2028 after changes become effective means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using the platform.
51. Changes to the Platform
Democracy 2028 may add, remove, modify, suspend, discontinue, rename, reprice, replace, or limit any feature, service, candidate tool, subscription plan, communication system, fact-checking process, event format, or platform function at any time.
Democracy 2028 is not liable for changes to the platform.
52. Force Majeure
Democracy 2028 shall not be liable for delays, failures, outages, losses, interruptions, cancellations, or inability to perform caused by events outside our reasonable control.
Such events may include natural disasters, war, terrorism, civil unrest, labor disputes, pandemics, government actions, cyberattacks, power failures, internet outages, third-party service failures, payment processor failures, cloud provider failures, telecommunications failures, or other force majeure events.
53. Assignment
You may not assign or transfer your rights or obligations under these Terms without Democracy 2028’s written consent.
Democracy 2028 may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, restructuring, financing, investment, change of control, or operation of law.
54. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
The invalid provision will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible.
55. No Waiver
Failure by Democracy 2028 to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.
56. Entire Agreement
These Terms, together with the Privacy Policy, Cookies Policy, Community Guidelines, Candidate Verification Policy, Payment Terms, Event Rules, Fact-Checking Policy, and any other applicable policies or written agreements, constitute the entire agreement between you and Democracy 2028 regarding your use of the platform.

Candidate-Specific Acknowledgment
By claiming, controlling, posting to, subscribing to, paying for, communicating through, or otherwise using a candidate page on Democracy 2028, each candidate, campaign, political committee, elected official, or authorized representative specifically acknowledges and agrees that Democracy 2028 does not endorse the candidate, the candidate is responsible for all posted content, the candidate is responsible for legal and campaign compliance, Democracy 2028 may automatically create and maintain candidate pages, Democracy 2028 may maintain unclaimed candidate pages for public information, candidates must pay applicable fees to claim and control certain platform features, paid fact-checking does not guarantee a favorable result, fact-checking results may be publicly posted, Democracy 2028 may moderate content and communications, Democracy 2028 may suspend or revoke access for violations, candidate communications must comply with all applicable laws, constituent data may only be used as permitted by Democracy 2028 and applicable law, and the candidate agrees to the waiver of claims, limitation of liability, indemnification, and dispute resolution provisions contained in these Terms.
Constituent-Specific Acknowledgment
By subscribing to, commenting on, liking, viewing, attending events for, receiving communications from, or otherwise interacting with a candidate page, each constituent acknowledges and agrees that they may receive communications from candidates they subscribe to, they may receive notifications from Democracy 2028, candidate statements are made by the candidate or campaign and not Democracy 2028, Democracy 2028 does not endorse candidates, comments may be moderated or removed, subscriptions may be modified or removed for safety or platform integrity, Democracy 2028 may display candidate information for civic and public-interest purposes, users should independently verify important election and voting information through official sources, and the user agrees to the waiver of claims, limitation of liability, indemnification, and dispute resolution provisions contained in these Terms.
